Terms of Service

The terms that govern studio booking, payment, gear hire and proofing.

These terms govern your use of Highkeyflair Studio ("the studio", "we") — an independent photography studio and gear-rental space in Kota Damansara, Malaysia — including booking the space, hiring gear and using our proofing galleries. By booking, paying or using the studio you agree to these terms.

1. The studio

Highkeyflair is a 1,188 SF space with a 4.77 m white cyclorama in Emporis, Persiaran Surian, Kota Damansara. It includes air-conditioning, wifi, power, parking and a changing room with coffee. You can book Studio Only (bring your own kit) or Fully Equipped (strobes, continuous lights, stands and modifiers set up for you).

2. Booking & payment

• Payment is due in full at booking to confirm your date. We confirm your slot and send payment details.
• Prices exclude SST and are shown on the booking page at checkout.
• Dates are held only once payment is received; an unpaid hold may be released.
• You choose a time block; the studio opens on your booked time.

3. Hours & overtime

Your block starts at your booked time. A 15-minute grace period applies, after which overtime is charged at the applicable hourly rate.

4. Cancellation & rescheduling

• Cancel inside 48 hours and 50% of the amount paid is kept.
• Cancel inside 24 hours and 100% of the amount paid is kept.
• Plan/member and repeat clients may move their day free up to 72 hours before.
• The studio may reschedule for maintenance or major events; any paid amount is honoured or refunded.

5. Damage, repaint & hold

• A refundable RM300 damage hold applies at check-out and is released once the space and kit are verified on return.
• The white cyc is repainted at up to RM800 if damaged.
• No tape, nails, markers or shoes on the cyc. You are responsible for the space, the kit and your guests.
• Gear hired with the studio is covered at replacement cost (see gear terms).

6. Gear hire

• Gear is charged per item per day at the published rate.
• In-studio gear is reserved against your block; external gear is delivery or self-collect.
• Damage is charged at replacement cost.
• Returns more than 2 hours late are charged at 1.5× the daily rate; consumables are charged per roll.

7. Proofing galleries

We provide a proofing gallery for client review — favourites/alternates, comments, print marks and retouch notes. Galleries have a selection window and may expire; the studio may set rounds, watermarks and review limits. Your selections guide the edit; the final edit is the studio's.

8. Intellectual property

The photographer retains copyright and a non-exclusive right to use images from a shoot for portfolio and promotion unless agreed otherwise in writing. You receive a licence to use the images delivered for your shoot or order. Gear hire does not transfer any intellectual property.

9. Your responsibilities

• Provide accurate booking and billing details.
• Be on time and keep within your booked block.
• Keep the space and kit clean, secure and undamaged.
• Conduct yourself professionally; the studio may decline off-brand or disruptive bookings.
• No alcohol or substances, and no commercial activity beyond the agreed purpose, without written consent.

10. Liability

To the extent permitted by law, the studio's liability is limited to the amount you paid for the booking or order. We are not liable for indirect or consequential loss, items you leave behind, or delays caused by events beyond our reasonable control. You are responsible for damage you or your guests cause to the studio or its kit.

11. Data

How we collect, use and protect your personal information is set out in our Privacy Policy.

12. Changes & termination

We may update these terms from time to time; the version published on this page applies. We may decline or cancel a booking that breaches these terms (with a refund of any amount not yet earned, or forfeited per the cancellation terms).

13. Governing law

These terms are governed by the laws of Malaysia, and any dispute is subject to the courts of Malaysia.
